Neither you nor Shepherd shall be liable for damages or have the right to terminate this Terms and Conditions and Privacy Policy for failure of or delay in performing its obligations if such failure or delay is the result of an act of God, such as earthquake, hurricane, tornado, flooding, or other natural disaster, or in the case of Government announcement to include but not limited to acts of war, action of foreign enemies, terrorist activities, labor dispute or strike, government sanction, blockage, embargo, or failure of electrical service, and/or any other cause beyond the reasonable control of the party whose performance is affected.
